1. Acceptance of terms
By creating an account, accessing, or using the Service, you affirm that you are at least 18 years old, or the age of legal majority in your jurisdiction, and legally capable of entering into a binding agreement. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree, you must not use the Service.
2. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website, by email, or through an in-product notice before they take effect. Your continued use of the Service after a change takes effect means you accept the updated Terms. Please review them periodically.
3. Description of service
Motqan combines AI-powered language tools with human expertise to help businesses create, translate, manage, and deliver content in different languages. The Service is offered on a self-serve basis through prepaid credits and subscription plans, and is provided on an “as available” basis. We may add, change, suspend, or remove features over time.
3.1 AI and human output
Motqan Services produces machine-generated output that may contain errors, omissions, or culturally inaccurate results, and is provided for your review. Human Validation and Human Translation involve qualified linguists and are intended to raise quality, but no translation, or content, whether machine or human, is guaranteed to be perfect or fit for every purpose. You are responsible for reviewing Deliverables before relying on or publishing them, particularly for legal, medical, financial, or safety-critical use.
3.2 Roadmap features
Some features may be described as planned or “coming soon,” including a quality-validation capability under which certain work that does not pass review would not be charged. Roadmap features are not part of the Service until we make them available, and nothing in our marketing or these Terms obliges us to release them on any particular timeline.
3.3 Beta and experimental features
From time to time, we may make features, models, or services available on a beta, early access, preview, or experimental basis (“Beta Features”), clearly labelled as such within the platform. Beta Features are made available so you can try new capabilities before they are fully released.
Beta Features:
• May be incomplete, less reliable, or less accurate than generally available features.
• May be changed, limited, or discontinued at any time without notice, including before a stable version is released.
• Are provided “as is” without any warranty, and our liability in connection with Beta Features is limited to the maximum extent permitted by law, in addition to the general disclaimers in Section 11.
• May be offered at a reduced credit cost, no cost, or a separately stated cost during the beta period, which may change once the feature is generally released.
We welcome feedback on Beta Features. By using a Beta Feature, you agree that any feedback you provide may be used by us to improve the Service without obligation or compensation to you.
4. User accounts
To access the Service you must create an account. You agree to:
• Provide accurate, current, and complete registration information.
• Maintain the security of your password and account credentials.
• Update your information promptly if it changes.
• Be responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account or any security breach.
We may suspend or terminate accounts that contain inaccurate or incomplete information, or that we reasonably suspect are being used fraudulently or in a way that endangers the Service or other users.
5. User responsibilities and conduct
You agree to use the Service lawfully and not to:
• Use the Service for any illegal or unauthorized purpose.
• Upload or generate content that is unlawful, infringing, defamatory, abusive, harassing, obscene, or otherwise objectionable.
• Submit content you do not have the necessary rights or permissions to process.
• Impersonate others or misrepresent your affiliation.
• Interfere with or disrupt the Service, its servers, or connected networks.
• Attempt unauthorized access to the Service, other accounts, or related systems.
• Use automated means (robots, scrapers) to access the Service without permission.
• Copy, resell, or exploit any part of the Service, or use it to build, train, or benchmark a competing language service, without our written consent.
6. Content ownership and licence
You retain all ownership rights in the content you submit to the Service (“Client Content”) and in the output produced for you (“Deliverables”), once the related fees or credits have been paid. We do not claim ownership of your Content.
By submitting Client Content, you grant us a limited, non-exclusive licence to host, store, process, transmit, and adapt it solely to the extent necessary to provide the Service to you, including routing work to AI engines and to human linguists who are bound by confidentiality obligations.
7. Intellectual property
The Service, including all software, designs, text, graphics, logos, trademarks, and content provided by Motqan, is the exclusive property of Future Group Language Solutions or its licensors and is protected by intellectual-property laws. The “Motqan” name and logo are our trademarks. Your use of the Service does not grant you any right to reproduce or use our intellectual property, or that of third parties, without permission. You may not reverse engineer, decompile, or create derivative works of the platform.
8. Plans, credits, and billing
8.1 Credit model
The Service is paid by using prepaid credits. You may obtain credits through a subscription plan, a one-time top-up, or pay-as-you-go, as described on our pricing page. Credits are spent against any service on the platform from a single balance. One credit equals one US dollar of services unless stated otherwise at purchase. All amounts are in US Dollars unless stated otherwise, and you are responsible for any applicable taxes.
8.2 Subscriptions and auto-renewal
Subscription plans renew automatically at the end of each billing cycle, unless you cancel before the renewal date. You can cancel at any time from your account; cancellation stops future renewals and takes effect at the end of the current cycle.
Users can still benefit from the system after cancel the subscriptions on Pay As You Go plan.
8.3 Bonus credits
Bonus credits granted with higher tiers are promotional. They carry the conditions stated when granted, have no cash value, and are non-refundable. Where a balance contains both paid and bonus credits, bonus credits may be consumed first.
8.4 Credit validity and portability
Credits are valid only for a limited period and expire as set out below. Expired credits are forfeited and have no cash value.
For monthly subscriptions, the credits granted each month expire at the end of that monthly billing cycle. Any credits not used within the month do not roll over into the following month.
For annual subscriptions, the full twelve (12) months’ worth of credits is granted at the start of the subscription and remains valid for the entire twelve-month period, expiring at the end of the twelve-month term.
Bonus and promotional credits expire on the same schedule as the paid credits in the period in which they were granted, unless a different expiry is stated at the time they are granted.
8.5 Free trial and launch offer
A free first month or free trial, where offered, is a one-time offer available only to eligible new accounts. It may not be claimed more than once and may not be obtained by reopening, duplicating, or creating additional accounts. We may withdraw or change promotional offers at any time for new sign-ups.
8.6 Payment authorization and non-payment
You authorize us, or our payment processor, to charge your selected payment method for all amounts due. If a payment fails or is reversed, we may suspend access to paid features until the amount is settled. We may also recover credits applied to your balance for a payment later charged back or refunded by your bank.
9. Refund policy
Because the Service delivers digital services and consumes credits as work is performed, the following refund terms apply. Nothing in this section limits any non-waivable statutory rights you may have under applicable consumer-protection law.
• Unused paid credits. Purchased credits not yet spent are non-refundable once purchased
• Bonus and promotional credits. Non-refundable and carry no cash value.
• Completed or in-progress services. Fees for services already performed or delivered are non-refundable, except where a Deliverable is materially defective and we are unable to correct it within a reasonable time.
• Subscriptions. Subscription fees are billed in advance and are non-refundable for the current cycle. Cancelling stops future renewals but does not by itself refund the current period unless required by law.
• Billing errors. If you believe you were charged in error, contact support@motqan.ai within [14] days and we will investigate and, where appropriate, issue a correction or refund.
10. Content standards policy
10.1 Your responsibility for content
You are solely responsible for the content you submit to the Service and for your use of any Deliverables. For AI-powered services, such as AI Translation and AI Content Creation, output is generated automatically from your inputs. Motqan does not review, endorse, or accept responsibility for the content processed or produced through these AI services, and you are responsible for reviewing it before relying on or publishing it.
10.2 Human-involvement services
For services that involve our linguists or reviewers, including but not limited to Human Validation and Human Translation, Motqan reserves the right to decline or to stop working on any content that we consider unlawful, offensive, or inappropriate, including but not limited to content that is sexually explicit, blasphemous, offensive to religious beliefs, or that promotes clearly prohibited activities. We may exercise this right at our discretion and are not obliged to give reasons.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service and all Deliverables are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Motqan and Future Group Language Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the total amount you paid us
12. Service levels and turnaround
Motqan does not guarantee specific turnaround times for AI Translation, Content Creation, Human Validation, Human Translation, or any other service, unless a turnaround time is expressly agreed in writing in a separate Service Level Agreement (“SLA”) or order confirmation.
Estimated delivery times shown in the platform, on the pricing page, or in any communication are indicative only and may vary based on content volume, language pair, complexity, linguist availability, and demand on the platform at the time of your request.
Where a service involves Human Validation or Human Translation, delivery depends on the availability of qualified linguists for the relevant language pair and subject matter. We will make reasonable efforts to meet displayed estimates but are not liable for delays.

13. API and integration use
Motqan may provide programmatic access to the Service through an application programming interface (“API”), software development kits (“SDKs”), or integrations with third-party platforms (collectively, the “API”). Access to the API may be limited to certain plans and is subject to these Terms in addition to any separate API documentation or usage policy we publish.
13.1 Acceptable use of the API
When using the API, you agree to:
• Use API keys and credentials only for your own account and not share them with unauthorized parties.
• Stay within any rate limits, volume limits, or usage quotas we publish or communicate to you.
• Use the API only for lawful purposes consistent with these Terms.
• Not use the API to scrape, replicate, or build a competing service, or to circumvent credit-based pricing on the platform.
We may monitor API usage, throttle or suspend access that exceeds published limits or that we reasonably believe risks the stability, security, or integrity of the Service, and revoke API credentials that are compromised, misused, or inactive for an extended period.
13.2 Third-party integrations
Where Motqan integrates with third-party platforms (such as content management systems, e-commerce platforms, or productivity tools), your use of those integrations is also subject to the third party’s own terms. We are not responsible for the availability, security, or performance of third-party platforms, and changes made by a third party to their own API or service may affect or interrupt the integration without notice from us.
13.3 No warranty on API availability
The API is provided on an “as available” basis. We do not guarantee uninterrupted API access and may modify, version, deprecate, or discontinue API endpoints with reasonable notice where practical.
14. Indemnification
You agree to indemnify and hold harmless Motqan and Future Group Language Solutions, and their affiliates, officers, employees, and agents, from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your Client Content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
15. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, or use the Service in a way that creates legal risk or harms the platform or other users. Where practical and lawful, we will give notice and an opportunity to remedy a breach first.
On termination, your right to use the Service ends. Sections that by their nature should survive, including content ownership, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, continue to apply. Data handling after termination follows the Data Retention section in Part B.
16. Governing law and dispute resolution
These Terms are governed by the laws of Dubai, UAE, without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute in good faith. Any dispute that cannot be resolved will be subject to the Dubai Courts.
17. Force majeure
Neither party will be liable for any failure or delay in performance under these Terms to the extent caused by circumstances beyond that party’s reasonable control, including but not limited to acts of God, natural disaster, war, terrorism, civil unrest, governmental action or regulation, labor disputes, internet or telecommunications failures, power outages, failures of third-party hosting or AI infrastructure providers, or cyberattacks (“Force Majeure Event”).
A party affected by a Force Majeure Event will make reasonable efforts to notify the other party and to resume performance as soon as reasonably practicable. If a Force Majeure Event continues for more than [30] consecutive days, either party may terminate the affected service without further liability, other than your right to any unused credits as set out in Section 9.
18. Miscellaneous
• Entire agreement: this document, together with any policies it references, is the entire agreement between you and us regarding the Service.
• Severability: if any provision is held invalid, the remaining provisions remain in effect.
• Waiver: our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: you may not transfer your rights without our prior written consent; we may transfer ours to an affiliate or successor.
